San Jose, California — San Jose police officers shot and killed a man last year as he drove a stolen car into a police sergeant, the District Attorney’s Office has determined. In the late morning of May 4, 2019, Efren Esquivel, 24, stole a sheriff’s deputy’s personal car as it idled unoccupied outside her home. After being found, he refused to surrender when surrounded by officers and then tried to smash his way out of the blockade with the car. Before he ran over the officer he yelled, “You’re gonna have to shoot me” or “You’re gonna have to kill me.” An autopsy determined that Esquivel was intoxicated with “a near-toxic” level of methamphetamines. Prosecutor Rob Baker wrote in the 30-page report: “When he drove at Sergeant (James) Mason at high speed, the officers had no other recourse to save Sergeant Mason than to discharge their firearms.”

“Had they not fired, the vehicle likely would not have come to a stop, allowing Esquivel to inflict greater injury to Sergeant Mason and possibly hit additional officers as he attempted to escape.” An hour after he stole the car, a theft that was caught on a security video, San Jose police officers found Esquivel sitting in the vehicle in the carport area of an apartment complex located on Kollmar Drive in San Jose. After refusing repeated commands to surrender, Esquivel drove the stolen car into a police car, trying to smash his way out. Then, he drove at the police officers, crushing Sgt. Mason between the stolen vehicle and another car parked nearby. Mason suffered a broken shoulder and other injuries. Three officers, Aaron Alvarez, Edward Carboni and Sgt. Mason, fired their weapons

  1. Why are cops trained to freak out and act at impulse ina situation where the “suspect” is yelling he’s scared? Why does the suspect have to remain calm?

  2. US police are so fucking dumb just let the guy ram the car why did that police officer stand in the way. Plenty of guns not enough brains over there.

  3. Terrible police work always gonna be trouble when perp delaying taser him after 2 commands shoot him as soon as he starts engine that officer could have got crushed

  4. Sorry, but the cops were kinda dumb for just standing there…move the freak out of the way you know?! Your life is more important than some dummy in a car. For real.

  5. I would not have that been standing in the path of that car even with a gun because the car doesn't stop immediately even if you shoot the driver.

  6. They knew there was the possibility of the car going toward them. They even said it. Why did they not re position inside to the rear of the suspect's car.

  7. Another idiot who played a stupid game and got a stupid prize. Looks like a justified shooting to me all day long. They should’ve just sick the dog on him that wouldn’t happen but then they have to deal with “why did you use the dog BS from all these woke people that hate police

  8. It should never have got that far they should have took him out sooner he had many changes but because the of arm chair experts who dont have to put their lifes on the line cops are getting scared to defend themselfs. If you go up against armed police and ignore their orders and threaten them you get what you deserve why should you have to wait till nearly kills some one.before shooting.

  9. What a situation. Imagine trying to manage crossfire while anticipating an exit strategy as you try to apprehend this clearly irrational perp.

  10. That sucks, the cops had to wait to the very last minute before shooting him and almost got killed in the process. Lose lose. You shot early, you are on trial, you shoot late, you are dead.

  11. Fkn cop should have hit behind or on top of the parked car, not only did he almost get run over twice but friendly fire from his cop buddy

  12. it is just that simple to realized this thug was dead afraid of the dog. With no dog in this vid, the thug would have obeyed the cops and would be alive now. BUT the COPS were incapacitated to realized this simple fact.

  13. That cop is fucking stupid not only that, the slowest reflexes on earth. Everyone was clear out the way and his brain was still processing what was happening smh. He needs to go back to desk duty after that close call.
